The situation is clogging up administrative courts with complaints against AIMA. This is happening at the same time as the new Nationality Law is generating a wave of legal challenges from investors who feel they have been defrauded, as reported by Sábado magazine.
Raquel Brito, a senior associate in the immigration department at Abreu Advogados, quoted by Sábado, states that “the process for renewing residence permits for golden visas is suffering significant delays, which are lasting for several months”.
Against a backdrop of administrative inertia, numerous summons proceedings are also being filed to protect rights, freedoms and guarantees, through a mechanism with a statutory 90-day deadline. Some of these are recommended by AIMA, but they are insufficient to prevent complaints from reaching the courts, which currently have 133,000 pending cases.
