‘Braga Mafia’ to remain behind bars

The group was jailed for kidnapping, murder and desecration of a corpse.

Earlier in 2017, six men named by Lusa News Agency as brothers Pedro, Adolfo and Manuel Bourbon, Rafael Silva, Hélder Moreira and Emanuel Paulino, were given the maximum penalty of twenty five years in prison after committing the heinous crimes of kidnapping, murder and the desecration of the corpse of a Braga businessman, whose body was dissolved in sulphuric acid.

A few months later, the gang’s lawyer attempted to challenge the decision, opening procedures at a higher level. The lawyer’s recourse was mostly unfruitful, with courts deciding to reduce one of the individual’s, the owner of the warehouse where the crimes took place, sentence by two years.

Earlier this year the gang made one last attempt at challenging their sentences, this time with the Supreme Court of Justice. Defence teams of four of the convicted men are making an effort to have the sentences completely revoked on the basis that the persecution used illegally obtained evidence to sustain their case, the ‘in dubio pro reo’ (when in doubt, absolve) principle was violated, and that evidence does not match the facts.

The Supreme Court of Justice is still to officially announce its decision, although it said that the individuals acted on a premeditated basis when murdering the business man, while plotting to make his body disappear. As far as motive goes, the businessman was trying to reverse a property transaction, in which his parent’s patrimony has been passed onto the control of two of the accused.
