In the public reading held at the Ratton Palace, in Lisbon, the reporting judge Carlos Medeiros Carvalho announced that the “TC decided unanimously not to pronounce on the unconstitutionality” of regulatory norms of the decree approved by the Assembly of the Republic on 19 July.

The explanation of the decision was reinforced by the president of the TC, José João Abrantes, “because he understands that, for the purposes of the duty of prior hearing (…), the matter does not present itself as involving issues concerning the autonomous regions”, since Marcelo Rebelo de Sousa had justified the sending with the "lack of consultation" with the government bodies of the autonomous regions of Madeira and the Azores.
